Terms of Use for JobSmart

Introduction
These Terms of Use ("Terms") govern your access to and use of the JobSmart mobile application, related booking pages, and supporting services (together, the "App" or "Services") operated by Blue Sparrow ("we", "us", or "our").
By downloading, accessing, or using JobSmart, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility
You may use JobSmart only if:
- you are at least 16 years old, or the minimum age required in your jurisdiction
- you have authority to enter into these Terms
- you are not prohibited from using the Services under applicable law
If you use JobSmart on behalf of a business, you confirm that you are authorized to bind that business to these Terms.
2. Account and Access
2.1 Account creation
JobSmart currently uses Google Sign-In for account access. You agree to provide accurate information and keep your account access secure.
2.2 Responsibility for account activity
You are responsible for activity that occurs under your account, including customer data, bookings, photos, invoices, and communications sent through the App.
2.3 Account suspension or termination
We may suspend or restrict access if you use the Services unlawfully, abusively, or in a way that threatens the App, other users, or our infrastructure.
3. License to Use JobSmart
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use JobSmart for your personal business or professional service workflow.
You may not:
- reverse engineer or attempt to extract source code except where allowed by law
- interfere with or disrupt the Services
- use the Services for unlawful, abusive, fraudulent, or misleading purposes
- use the App to send spam or unauthorized communications
- attempt unauthorized access to systems, accounts, or data
4. Permitted Use of the App
JobSmart is intended to help solo technicians and similar service professionals:
- receive public booking requests
- create bookings manually
- manage customer and service information
- capture problem description, diagnosis, work performed, and technician notes
- collect before and after photos
- collect digital signatures
- generate invoices and job reports
- send booking confirmations, invoices, receipts, and payment emails
- track payment status
5. Customer Data and Business Use
If you use JobSmart for your business, you are responsible for:
- the accuracy of the information you enter
- obtaining any necessary permissions, notices, or consents from your customers
- complying with privacy, consumer, marketing, and data protection laws that apply to you
- ensuring that any photos, signatures, messages, invoices, and communications you send are lawful and appropriate
You remain responsible for how you use customer data that you store or process through JobSmart.
6. Public Booking Pages and Communications
JobSmart may provide you with a public booking page for customer requests.
Customers may submit booking details such as contact information, service address, service type, and problem description. You are responsible for reviewing, managing, confirming, and following up on those requests.
JobSmart also supports operational customer communications, including:
- booking-related emails
- invoice emails
- receipt emails
- payment emails
Some customer emails may be triggered only when you explicitly choose to send them.
7. Your Content
7.1 Ownership
You retain ownership of content you upload or create in JobSmart, including:
- profile and business information
- booking and customer information
- photos
- signatures
- invoices
- technician notes and job documentation
7.2 Limited license to us
You grant us a limited right to host, process, transmit, back up, and display your content only as needed to provide and improve the Services.
7.3 Content standards
You must not upload or send content that is unlawful, abusive, infringing, deceptive, harmful, or otherwise improper.
8. Subscription, Free Tier, and Billing
8.1 Plans
JobSmart currently offers:

8.2 Trial and billing
Trials, purchases, renewals, cancellations, refunds, and billing are generally handled through the relevant app store and our subscription or billing partners.
8.3 Pricing
Pricing may change over time. Any updated pricing will apply prospectively as allowed by the app store and applicable law.
8.4 Branding and white-labeling
Free-plan invoices may include a subtle JobSmart footer or branding element. Premium removes that footer for white-label invoices and unlocks the full 12-template invoice library.
9. Third-Party Services
JobSmart relies on third-party providers such as:
- authentication providers
- subscription and billing providers
- email delivery services
- map, routing, or address services
- hosting and infrastructure providers
Your use of relevant third-party functionality may also be subject to those providers' terms and policies.
10. Feedback and Suggestions
If you send us feedback, suggestions, or ideas, we may use them to improve JobSmart without any obligation to compensate you.
11. Availability and Changes
We may update, improve, limit, or discontinue features of JobSmart from time to time. We may also release new workflows, template systems, billing rules, limits, or integrations.
We do not guarantee that every feature will always be available, uninterrupted, or error-free.
12. Disclaimers
JobSmart is provided on an "as available" and "as is" basis to the extent permitted by applicable law.
We do not guarantee:
- uninterrupted availability
- error-free operation
- compatibility with every device or network environment
- that the App will meet every business, tax, accounting, or legal requirement you may have
JobSmart is a workflow tool. It does not provide legal, tax, accounting, compliance, or financial advice.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Blue Sparrow will not be responsible for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, business opportunities, or data.
Nothing in these Terms excludes rights or remedies that cannot be limited under applicable law.
14. Indemnity
To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, or expenses arising from:
- your misuse of the Services
- your violation of these Terms
- your unlawful use of customer data, photos, signatures, or communications
- your business activities conducted through JobSmart
15. Termination
You may stop using JobSmart at any time. We may suspend or end access where reasonably necessary to protect the Services, comply with law, or address misuse.
Sections that by their nature should continue after termination will continue to apply, including sections about content responsibility, disclaimers, liability, and general legal provisions.
16. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last Updated" date and may provide notice in the App or by other reasonable means.
Your continued use of JobSmart after revised Terms become effective means you accept the updated Terms.
17. General Provisions
These Terms and our Privacy Policy form the core agreement between you and Blue Sparrow regarding JobSmart.
If one provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Any failure by us to enforce a provision is not a waiver of that provision.
These Terms are intended to be interpreted fairly and in a manner consistent with mandatory consumer protection laws that apply to you.
