Introduction
Welcome to JobSmart! These Terms of Use ("Terms") govern your access to and use of the JobSmart mobile application (the "App") operated by Blue Sparrow ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Eligibility
To use the App, you must:
- Be at least 16 years of age (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the App under applicable laws
By using the App, you represent and warrant that you meet these eligibility requirements.
2. Account Registration
2.1 Account Creation
To access the App's features, you must create an account using Google Sign-In. You agree to:
- Provide accurate and complete information
- Keep your account credentials secure
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
2.2 Account Termination
You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Use of the App
3.1 License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or business purposes.
3.2 Permitted Uses
You may use the App to:
- Manage customer bookings and appointments
- Capture and store job documentation photos (before/after)
- Document job details (problem, diagnosis, work performed, warranty)
- Collect digital signatures from customers
- Generate and share Job Report & Invoice PDFs with embedded photos and signatures
- Track payment status
- Receive notifications about your bookings
3.3 Prohibited Uses
You agree NOT to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Reverse engineer, decompile, or disassemble the App
- Distribute malware or harmful code through the App
- Interfere with the App's operation or other users' access
- Use automated systems to access the App without permission
- Misrepresent your identity or affiliation
- Violate any applicable laws, regulations, or third-party rights
- Use the App to send spam or unsolicited communications
- Collect or harvest other users' information without consent
4. User Content
4.1 Your Content
You retain ownership of all content you create, upload, or store in the App, including:
- Business profile information
- Customer booking data
- Job photos
- Invoices and notes
4.2 Content Responsibility
You are solely responsible for:
- The accuracy of your business information
- Obtaining any necessary consents from your customers
- Complying with applicable privacy and data protection laws
- The content of invoices and communications you send
4.3 Content License
By using the App, you grant us a limited license to process and store your content solely for the purpose of providing the App's services to you.
5. Subscription and Payments
5.1 Subscription Tiers
The App offers the following subscription options:

5.2 Free Trial
All new users receive a 14-day free trial of Pro features. No credit card is required to start the trial. After 14 days, you will be charged the subscription price unless you cancel before the trial ends.
5.3 Payment Processing
- Payments are processed through Google Play Store
- Subscriptions automatically renew unless cancelled
- You may cancel at any time through Google Play settings
- No refunds for partial subscription periods unless required by law
5.4 Price Changes
We may change subscription prices with reasonable notice. Price changes will apply to subsequent billing periods after the change date.
5.5 Free Tier Limitations
- Bookings: Limited to 10 bookings per calendar month
- Photos: Limited to 50 photo uploads per calendar month
Additional bookings or photos require a Pro subscription.
5.6 Invoice Watermark
All invoices generated by the App include a subtle "JobSmart by BlueSparrow Labs" watermark. This watermark appears on both free and Pro tier invoices.
6. Intellectual Property
6.1 Our Rights
The App, including its design, features, graphics, and code, is owned by Blue Sparrow and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App except as expressly permitted.
6.2 Trademarks
"JobSmart," "Blue Sparrow," and associated logos are our trademarks. You may not use them without our prior written permission.
6.3 Feedback
If you provide suggestions or feedback about the App, we may use and incorporate such feedback without any obligation to you.
7. Third-Party Services
7.1 Integrated Services
The App integrates with third-party services including:
- Google Sign-In (authentication)
- Firebase (cloud services)
- RevenueCat (subscription management)
- Email service providers
Your use of these services is subject to their respective terms and privacy policies.
7.2 Third-Party Links
The App may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites.
8. Disclaimers
8.1 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness
8.2 No Guarantee
We do not guarantee that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App will meet your specific requirements
- Data will never be lost or corrupted
8.3 Business Decisions
You are solely responsible for your business decisions. The App is a tool to help manage bookings and invoices, but we do not provide business, legal, tax, or financial advice.
9. Limitation of Liability
9.1 Extent of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or business opportunities
- Costs of substitute services
- Damages arising from your use or inability to use the App
9.2 Maximum Liability
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €50, whichever is greater.
9.3 Essential Purpose
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Blue Sparrow from any claims, damages, losses, or expenses (including reasonable professional fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your business activities conducted through the App
11. Changes to the App and Terms
11.1 App Changes
We may modify, update, or discontinue the App or any feature at any time. We will provide reasonable notice for significant changes.
11.2 Terms Updates
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
- Sending a notification for significant changes
Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
12. Termination
12.1 By You
You may stop using the App and delete your account at any time.
12.2 By Us
We may suspend or terminate your access if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay subscription fees
- Use the App in a manner that harms other users or our systems
12.3 Effect of Termination
Upon termination:
- Your license to use the App ends
- You remain responsible for any outstanding payments
- Provisions that by their nature should survive will continue (including Sections 6, 8, 9, 10, and 13)
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blue Sparrow regarding the App.
13.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.
13.3 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision.
13.4 Assignment
You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
13.5 Language
These Terms are provided in English. If translations are provided, the English version shall prevail in case of any discrepancy.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal process, you agree to contact us at info@bluesparrow.dev to attempt to resolve any dispute informally. We will work in good faith to address your concerns within 30 days.
14.2 Governing Principles
These Terms shall be interpreted in accordance with generally accepted principles of fairness and good faith, with consideration given to the laws applicable in your place of residence.
14.3 Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under applicable local laws. If any provision conflicts with mandatory consumer protection laws in your jurisdiction, that provision will be modified to the minimum extent necessary to comply with such laws.
15. Regional Provisions
15.1 European Union Users
If you are in the EU:
- You have the right to withdraw from your subscription within 14 days of purchase, subject to Google Play's policies
- Consumer protection laws of your country of residence apply
- We process your data in accordance with GDPR
15.2 United States Users
If you are in the United States:
- These Terms are governed by applicable federal and state laws
- California residents have additional rights under the CCPA
15.3 Indian Users
If you are in India:
