SunshineTracker — Terms of Use

1. Agreement to Terms

By downloading, installing, or using SunshineTracker ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a binding agreement between you and BlueSparrow, an independent developer based in India.

2. Description of Service

SunshineTracker is a weather-powered safe sunshine planning application that:

• Analyzes real-time weather and UV data to identify the best times for safe outdoor sunshine exposure
• Provides sunshine quality scores based on UV index, cloud cover, temperature, wind, precipitation, and air quality
• Displays an interactive Sun Map with saved locations and sunshine scores
• Offers a Sun Compass showing real-time sun direction, elevation, sunrise/sunset, and solar noon
• Delivers smart notifications for sunshine windows, UV safety, and weather changes
• Tracks sunshine history and outdoor planning habits

3. Health, Safety, and Content Disclaimer

3.1 Informational Purpose Only

SunshineTracker provides sunshine window recommendations, UV index information, and weather-based guidance for informational and planning purposes only. All content, scores, recommendations, and alerts are intended to assist with outdoor planning and general sun awareness.

3.2 Not Medical or Health Advice

The App does not provide medical advice, health diagnoses, or treatment recommendations. Sunshine scores, UV safety alerts, and any related guidance are not substitutes for professional medical consultation. Users with health concerns related to sun exposure should consult a qualified healthcare professional.

3.3 UV Safety Guidelines

The UV safety information is based on publicly available guidelines from recognized organizations (WHO, EPA, CDC). These guidelines are general in nature and may not account for individual factors such as skin type and sensitivity, existing medical conditions or medications, altitude or reflective surfaces, or personal health history.

3.4 Weather Data Accuracy

Weather and UV forecasts are sourced from third-party data providers. We do not guarantee the accuracy, completeness, reliability, or timeliness of any weather or UV information displayed in the App.

3.5 User Responsibility

You are solely responsible for your own sun safety decisions, outdoor activities, and health. SunshineTracker is a planning aid and should be used alongside your own judgment and professional advice where appropriate.

3.6 No Endorsement

The App does not endorse, promote, or recommend any specific sunscreen product, health supplement, or medical treatment.

4. Eligibility

To use SunshineTracker, you must:

• Be at least 13 years of age (or the minimum age required by applicable regulations)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable regulations

If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

5. Account Registration

5.1 Account Creation

You may create an account using Google Sign-In. Account creation is optional — the App can be used without signing in, with limited functionality. If you create an account, you are responsible for maintaining the confidentiality of your credentials, all activities under your account, and notifying us immediately of any unauthorized use at info@bluesparrow.dev.

5.2 Account Information

You agree to provide accurate and current information when creating an account. We reserve the right to suspend or terminate accounts associated with false or misleading information.

5.3 Account Deletion

You may delete your account at any time through Settings → Account → Delete Account. Account deletion will permanently remove all associated data from our systems within 30 days.

6. Subscription and Payments

6.1 Free and Premium Tiers

Free Tier includes:

• Today's sunshine window scores and recommendations
• Up to 5 saved locations
• 7-day sunshine history
• Basic UV safety alerts and notifications
• Sun Map and Sun Compass features

Premium Tier includes:

• 3-day sunshine forecast
• Unlimited saved locations
• Unlimited sunshine history
• Google Drive backup and restore
• Advanced planning notifications
• Multi-location alerts
• All future premium features

6.2 Subscription Terms

• Subscriptions are billed through Google Play Store or Apple App Store
• Subscriptions automatically renew unless cancelled before the end of the current billing period
• Prices are displayed in your local currency and may vary by region

6.3 Cancellation

You may cancel your subscription at any time through your device's subscription management settings (Google Play Store or Apple App Store). Cancellation takes effect at the end of the current billing period. No partial refunds are provided.

6.4 Refunds

Refund requests are handled by Google Play Store or Apple App Store according to their respective refund policies.

6.5 Price Changes

We may change subscription prices with reasonable advance notice. Continued subscription after a price change constitutes acceptance of the new pricing.

6.6 Free Tier Changes

We reserve the right to modify the features included in the free tier with reasonable notice. Core safety features (UV safety alerts) will remain available to all users.

7. Acceptable Use

7.1 You Agree To:

• Use the App only for its intended purpose of sunshine planning and sun safety awareness
• Comply with all applicable regulations in your jurisdiction
• Respect the intellectual property rights contained in the App
• Maintain the security of your account

7.2 You Agree NOT To:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Modify, adapt, translate, or create derivative works based on the App
• Use the App for any unlawful, harmful, or fraudulent purpose
• Attempt to gain unauthorized access to our systems, servers, or networks
• Interfere with or disrupt the App's functionality or infrastructure
• Use automated systems, bots, or scrapers to access the App
• Share, resell, or redistribute premium access or account credentials
• Use the App's data to provide competing services without authorization
• Circumvent access controls, premium feature gating, or security measures

8. Intellectual Property

8.1 App Content and Software

SunshineTracker, including its design, user interface, features, functionality, code, graphics, icons, and documentation, is owned by BlueSparrow and protected by applicable intellectual property regulations. All rights not expressly granted to you are reserved.

8.2 Weather and UV Data

Weather and UV data are sourced from third-party providers and subject to their respective terms. This data is provided for personal, non-commercial use within the App only.

8.3 User Feedback

Any feedback, suggestions, bug reports, or ideas you voluntarily provide may be used by us to improve the App without compensation, attribution, or obligation.

8.4 Trademarks

"SunshineTracker," "BlueSparrow," and associated logos, icons, and brand elements are trademarks of BlueSparrow.

8.5 Open-Source Components

The App may include open-source software components, each governed by its respective open-source license.

9. Privacy

Your use of SunshineTracker is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

10. Disclaimers

10.1 "As Is" Service

SunshineTracker is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or reliability of data, and uninterrupted or error-free operation.

10.2 Weather and UV Data

We do not guarantee the accuracy, completeness, or timeliness of weather forecasts, UV index data, or sunshine scores. Weather conditions can change rapidly and may differ from forecasted data.

10.3 Device Compatibility

We do not guarantee the App will work on all devices, operating system versions, or in all network conditions. Some features require location services, compass/orientation sensors, internet connectivity, or background execution permissions.

10.4 Third-Party Services

The App integrates with third-party services (Google, RevenueCat, weather data providers). We are not responsible for the availability, accuracy, content, policies, or practices of these third-party services.

10.5 No Professional Advice

Nothing in the App constitutes medical, health, dermatological, or any other form of professional advice. The App is a planning tool, not a health or safety device.

11. Limitation of Responsibility

11.1 General Limitations

To the maximum extent permitted by applicable regulations, BlueSparrow shall not be held responsible for indirect, incidental, special, consequential, or punitive damages; loss of profits, data, goodwill, or other intangible losses; damages resulting from unauthorized access to or alteration of your data; health consequences from sun exposure decisions made using the App; damages resulting from inaccurate weather or UV data; or any damages exceeding the total amount you paid for the App in the 12 months preceding the event.

11.2 Jurisdictional Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, our responsibility shall be limited to the fullest extent permitted by applicable regulations.

12. Indemnification

You agree to defend, indemnify, and hold harmless BlueSparrow from and against any claims, damages, obligations, losses, expenses, or fees arising from your use of the App, your violation of these Terms, your violation of any third-party rights, or your violation of any applicable regulations.

13. Modifications to Service

We reserve the right to modify, update, or enhance any aspect of the App; add or remove features; temporarily or permanently suspend the App; change the weather data provider; or update these Terms with reasonable notice.

Continued use of the App after modifications constitutes acceptance of the changes.

14. Termination

14.1 By You

You may stop using the App at any time. You may delete your account through the App's settings. You may uninstall the App at any time.

14.2 By Us

We may suspend or terminate your access if you violate these Terms, engage in fraudulent or abusive activity, fail to pay subscription fees, or use the App in a manner that could damage or impair our services.

14.3 Effect of Termination

Upon termination, your right to access the App ends immediately; no refunds will be provided for remaining subscription periods; we may delete your account data within 30 days. Provisions that by their nature should survive termination will continue in effect.

15. Dispute Resolution

15.1 Informal Resolution First

Before initiating any formal proceedings, you agree to contact us at info@bluesparrow.dev to attempt informal resolution. We commit to responding within 30 days.

15.2 Governing Regulations

These Terms are governed by the regulations of India, without regard to conflict of law principles. This choice does not deprive you of any mandatory consumer protection rights available under the regulations of your country of residence.

15.3 Consumer Rights Preserved

Nothing in these Terms limits your rights as a consumer under mandatory consumer protection regulations in your jurisdiction.

15.4 Regional Considerations

EU/EEA Users: You may submit disputes to the Online Dispute Resolution (ODR) platform provided by the European Commission at https://ec.europa.eu/consumers/odr/.

US Users: You agree to resolve disputes through binding individual arbitration administered by a recognized arbitration provider, except where prohibited by applicable state regulations.

Other Jurisdictions: Users retain all dispute resolution rights provided by their local consumer protection regulations.

16. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and BlueSparrow regarding the App.
• Severability: If any provision is found invalid, the remaining provisions continue in full force.
• Waiver: Failure to enforce any right does not constitute a waiver.
• Assignment: You may not assign your rights without our consent. We may assign ours to a successor.
• Force Majeure: We shall not be responsible for delays due to circumstances beyond our control.
• Language: In case of discrepancy between English and translated versions, the English version prevails.

18. Export Compliance

You agree to comply with all applicable export and re-export control regulations. You represent that you are not located in any country subject to comprehensive trade sanctions, and that you are not on any restricted party list.
