ImageLab — Terms of Service

1. Acceptance of Terms

Welcome to ImageLab ("the App"), operated by Blue Sparrow Labs ("we," "us," or "our"). By downloading, installing, or using ImageLab, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

ImageLab is a mobile application available on Android and iOS platforms that provides offline image processing capabilities, including:

• Image format conversion (JPG, PNG, BMP, TIFF)
• Image compression and optimization
• Watermarking (text and logo)
• Image resizing, cropping, and rotation
• Basic image editing (brightness, contrast, filters)
• Batch processing operations
• EXIF metadata viewing and editing

The App operates primarily offline on your device, with minimal cloud connectivity required only for authentication and subscription management.

3. Account Registration and Authentication

3.1 Required Authentication

• Android Users: Must sign in using a valid Google account
• iOS Users: Must sign in using a valid Apple ID
• Authentication is mandatory to use the App

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

3.3 Account Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use ImageLab. By using the App, you represent that you meet this age requirement.

4. License and Restrictions

4.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use ImageLab for personal or commercial purposes, subject to these Terms.

4.2 Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works of the App
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Use the App to process images that violate third-party rights or applicable laws
• Distribute malware, spam, or other harmful content through the App
• Interfere with or disrupt the integrity or performance of the App

5. Subscription and Payment Terms

5.1 Free Tier

• 20 image operations per day
• Basic format conversion (JPG, PNG, BMP)
• Single text watermark
• Standard compression quality
• Ad-supported experience

5.2 Premium Subscription

• Monthly Plan: $4.99 USD per month
• Annual Plan: $29.99 USD per year

Premium features include unlimited operations, all format support (including TIFF), advanced compression controls, multiple watermarks and templates, logo/image watermarks, professional editing tools, ad-free experience, and priority support.

5.3 Payment Processing

Payments are processed through Google Play Store (Android) or Apple App Store (iOS). All purchases are subject to the respective platform's terms and conditions. Prices are in U.S. Dollars and may vary by region. Applicable taxes will be added at checkout.

5.4 Billing and Auto-Renewal

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your payment method will be charged within 24 hours prior to the start of each renewal period
• You can manage your subscription and turn off auto-renewal in your device's account settings

5.5 Free Trial (If Offered)

If a free trial is offered, you will not be charged until the trial period ends. Cancel before the trial ends to avoid charges.

5.6 Refund Policy

Subscription purchases are generally non-refundable. Refund requests must be made through Google Play Store or Apple App Store according to their policies. We may offer refunds at our sole discretion for billing errors or technical issues preventing app usage.

5.7 Price Changes

We may change subscription prices at any time. Price changes will not affect your current subscription period, and you will be notified of price changes at least 30 days in advance.

6. User Content and Intellectual Property

6.1 Your Content

You retain all ownership rights to images you process using ImageLab. We do not claim ownership of your images; processing happens locally on your device.

6.2 Limited Processing Rights

By using the App, you grant us a limited license to process your images solely for providing the App's functionality. This license terminates when you delete the images from the App.

6.3 Our Intellectual Property

ImageLab, including its code, design, features, and trademarks, is owned by Blue Sparrow Labs. All rights not expressly granted to you are reserved.

6.4 Prohibited Content

You agree not to process images that:

• Violate any copyright, trademark, or other intellectual property rights
• Contain illegal, harmful, threatening, abusive, or defamatory content
• Depict minors in inappropriate contexts
• Violate any applicable laws or regulations
• Infringe upon the privacy or publicity rights of others

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using ImageLab, you consent to our Privacy Policy.

8. Disclaimers and Limitations of Liability

8.1 "AS IS" Basis

ImageLab is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, or accuracy of results.

8.2 No Guarantee of Quality

While we strive to provide high-quality image processing, we do not guarantee perfect image quality, preservation of all image characteristics, compatibility with all image formats or devices, or recovery of lost or corrupted images.

8.3 Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

8.4 Backup Responsibility

You are solely responsible for backing up your images before processing. We are not liable for any loss or damage to your images resulting from use of the App.

9. Indemnification

You agree to indemnify, defend, and hold harmless Blue Sparrow Labs, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of ImageLab, violation of these Terms, violation of third-party rights, or content processed through the App.

10. Third-Party Services

10.1 Authentication Services

Google Sign-In (Android) and Apple Sign-In (iOS) are subject to their respective terms. We are not responsible for the availability or functionality of these services.

10.2 Payment Processing

In-app purchases are processed by Google Play Store or Apple App Store. Payment disputes should be directed to the respective platform.

10.3 Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites.

11. Termination

11.1 Termination by You

You may stop using the App at any time and delete it from your device. To cancel your subscription:

• Android: Manage subscriptions in Google Play Store
• iOS: Manage subscriptions in App Store

11.2 Termination by Us

We may suspend or terminate your access to ImageLab at any time, with or without notice, for violations of these Terms, fraudulent or illegal activity, abuse, or non-payment of subscription fees.

11.3 Effect of Termination

• Your right to use the App immediately ceases
• You must delete the App from all devices
• Subscription fees already paid are non-refundable except as required by law
• Provisions that should survive termination (e.g., disclaimers, limitations of liability) will remain in effect

12. Changes to Terms

We may modify these Terms at any time. Changes are effective immediately upon posting in the App or on our website, or 30 days after notification for existing users. Continued use constitutes acceptance of the updated Terms.

13. Geographic Restrictions

ImageLab is intended for use worldwide, subject to local laws. You are responsible for ensuring your use complies with applicable laws in your jurisdiction.

14. Export Control

You agree to comply with all applicable export and import control laws and regulations, including restrictions imposed by the United States and other countries.

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to conflict of law principles.

15.2 Informal Resolution

If you have a dispute with us, please contact us at info@bluesparrow.dev first. We will attempt to resolve disputes informally before pursuing formal legal action.

15.3 Arbitration (If Applicable)

If informal resolution fails, disputes may be resolved through binding arbitration in accordance with the rules of a recognized arbitration organization, rather than in court, except where prohibited by law.

15.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute will be resolved individually and not as a class action or representative proceeding.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blue Sparrow Labs regarding ImageLab and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
