1. Acceptance of Terms
By downloading, installing, accessing, or using HabitSet ("App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and BlueSparrow Labs ("we," "our," or "us").

3. Description of Service
HabitSet is a story-driven habit tracking application that allows users to:
- Create and manage habits with custom categories, colors, and schedules
- Track habit completions, streaks, and at-risk warnings
- Unlock story cards through habit consistency (gamification)
- Use Swipe Session Mode for quick daily habit completion
- View analytics including heatmaps, trends, and completion rates
- Track mood alongside habit completions
- Record voice notes using speech-to-text
- Secure the app with biometric lock (fingerprint/face)
- Back up data to Google Drive (encrypted)
- Sync data across devices via Cloud Firestore (Premium)
- Export data for personal use
- Receive smart notifications with quiet hours
We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice.
4. Eligibility
You must be at least 13 years of age (or 16 in the EU/EEA) to use HabitSet. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using the App, you represent and warrant that you meet these eligibility requirements.
5. User Accounts
5.1 Account Creation
You may sign in using Google Sign-In via Firebase Authentication. By creating an account, you agree to provide accurate information.
5.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
5.3 Account Restrictions
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or compromise the App's security.
6. Subscription and Payments
6.1 Free Tier
HabitSet offers a free tier with:
- Up to 3 active habits
- Up to 3 story cards per habit
- Basic analytics
- Weekly backup to Google Drive
6.2 Premium Subscription
Premium features include unlimited habits, unlimited story cards, advanced analytics (heatmaps, trends), daily backup, cloud sync, and priority support.
6.3 Pricing

A 7-day free trial is available. No payment is required to start the trial and it does not auto-convert to a paid subscription.
6.4 Billing
All subscriptions are processed through Google Play. BlueSparrow Labs never receives or stores your payment card information. Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends.
6.5 Refunds
Refund requests are handled by Google Play according to their refund policy. BlueSparrow Labs does not process refunds directly.
7. User Conduct
7.1 Acceptable Use
You agree to use the App only for its intended purpose - personal habit tracking and self-improvement.
7.2 Prohibited Activities
You agree NOT to:
- Reverse engineer, decompile, or disassemble the App
- Attempt to bypass subscription, cloud, or security mechanisms
- Use automated scripts, bots, or scrapers to interact with the App
- Upload harmful, offensive, or illegal content
- Interfere with other users' access to the service
- Use the App for any commercial purpose without authorization
7.3 Enforcement
Violation of these rules may result in immediate suspension or termination of your account without notice.
8. User-Generated Content
8.1 Ownership
You retain full ownership of all content you create within the App, including habits, notes, moods, voice notes, and story card progress.
8.2 License to Us
By using the App, you grant BlueSparrow Labs a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing and improving the service.
8.3 Content Responsibility
You are solely responsible for the content you create. We do not monitor or review user-generated content.
9. Intellectual Property
9.1 App Ownership
HabitSet, including its design, code, graphics, animations, story card system, and all associated intellectual property, is owned by BlueSparrow Labs.
9.2 Trademarks
"HabitSet" and the HabitSet logo are trademarks of BlueSparrow Labs.
9.3 Restrictions
You may not copy, modify, distribute, sell, or create derivative works based on the App without explicit written permission.
9.4 Feedback
Any feedback, suggestions, or ideas you provide about the App may be used by BlueSparrow Labs without obligation to you.
10. Third-Party Services
10.1 Integrated Services
The App uses the following third-party services:
- Firebase (Google) - Authentication, Firestore, Analytics, Crashlytics
- Google Play - App distribution and payments
- RevenueCat - Subscription management
- Google Drive - Optional encrypted backup
10.2 Third-Party Terms
Your use of third-party services is subject to their respective terms and privacy policies.
10.3 No Endorsement
Integration with third-party services does not constitute endorsement. We are not responsible for third-party service availability or practices.
11. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.
12. Disclaimers
12.1 "As Is" Service
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
12.2 No Guarantee
We do not guarantee that the App will be uninterrupted, error-free, secure, or free of viruses or harmful components.
12.3 Habit Tracking Disclaimer
HabitSet is a personal productivity tool. Habit completion data, streaks, and analytics are for personal reference only and should not be relied upon as a sole measure of personal progress or achievement.
12.4 Health Disclaimer
HabitSet is NOT a medical, health, or therapeutic application. Any health-related habits you track are your personal responsibility. Always consult qualified healthcare professionals for health-related decisions.
13. Limitation of Liability
13.1 Maximum Liability
To the maximum extent permitted by applicable law, BlueSparrow Labs' total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.
13.2 Exclusion of Damages
In no event shall BlueSparrow Labs be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury.
13.3 Exceptions
Some jurisdictions do not allow the exclusion of certain warranties or liabilities. In such cases, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless BlueSparrow Labs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or share through the App
15. Account Deletion
15.1 Self-Service Deletion
You can delete your account at any time through Settings > Account > Delete Account within the App, or via our website.
15.2 Deletion Process
- A 30-day grace period applies, during which you can recover your account
- After 30 days, all cloud data (habits, completions, notes, moods, story cards) are permanently deleted from our servers
- Local data on your device is not affected until you uninstall the App
- Google Drive backups remain in your Drive until you delete them manually
16. Modifications to Service
We may modify, update, or discontinue parts of HabitSet at any time. For significant changes:
- We will provide reasonable advance notice via the App or email
- Premium features will not be removed during an active subscription period without providing a comparable alternative
- If you disagree with changes, you may cancel your subscription and stop using the App
17. Changes to Terms
We may update these Terms from time to time. When we make changes:
- The "Effective Date" will be updated
- For material changes, we will notify you via the App or email
- Continued use of the App after changes constitutes acceptance
- If you disagree with updated Terms, you must stop using the App
18. Termination
18.1 By You
You may stop using the App at any time. You may cancel your subscription through Google Play and delete your account through the App.
18.2 By Us
We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or pose a security risk. We will provide notice when reasonably possible.
18.3 Effect of Termination
Upon termination:
- Your right to use the App ceases immediately
- We may delete your cloud data after 30 days
- Provisions that by nature should survive termination will continue to apply (e.g., Limitation of Liability, Indemnification, Dispute Resolution)
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BlueSparrow Labs regarding the App.
19.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
19.4 Assignment
You may not assign your rights under these Terms. BlueSparrow Labs may assign its rights without restriction.
19.5 Force Majeure
Neither party shall be liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, pandemics, or government actions.
20. Dispute Resolution
20.1 Informal Resolution
Before filing a formal dispute, you agree to contact us at info@bluesparrow.dev to attempt to resolve the issue informally within 30 days.
20.2 Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in the competent courts of the jurisdiction where BlueSparrow Labs is established.
21. Regional Provisions
21.1 European Union / United Kingdom
Nothing in these Terms affects your statutory rights as a consumer under EU/UK law. You may have the right to cancel your subscription within 14 days of purchase.
21.2 United States
These Terms affect your legal rights. By using the App, you agree to the Dispute Resolution provisions above.
21.3 India
These Terms are subject to the applicable consumer protection and data privacy laws of India.
21.4 Other Jurisdictions
If any provision of these Terms conflicts with mandatory local laws, those local laws shall prevail to the extent of the conflict.
