PDF Lab — Terms of Service

These Terms of Service (the "Terms") govern your access to and use of PDF Lab (the "App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. About the App

PDF Lab is a freemium mobile application that provides local, on‑device PDF tools for Android devices. The App enables you to perform comprehensive PDF operations including:

• Document Management: Merge multiple PDFs, split documents by page ranges, extract specific pages, and reorder pages
• Optimization: Compress PDFs to reduce file size while maintaining quality
• Conversion: Convert images (JPG, PNG) to PDF, convert PDFs to images, and convert HTML web pages to PDF
• Annotation & Security: Sign PDFs with drawn or imported signatures, add custom watermarks, and insert page numbers
• Document Scanning: Use your camera to scan physical documents and convert them to PDF
• Text Recognition: OCR (Optical Character Recognition) to extract text from scanned documents
• Page Operations: Rotate pages, adjust orientation, and manage page layout

A free tier with monthly usage limits is available; premium subscriptions offer unlimited operations and advanced features.

2. Eligibility

You must be legally capable of entering into a binding contract to use the App. The App is not intended for children under the age of 13 (or the applicable age of digital consent in your jurisdiction). By using PDF Lab, you represent and warrant that you meet these eligibility requirements.

3. Account and Sign‑In

3.1 Required Authentication

• Google Sign‑In is required to use the App
• You must have a valid Google account
• Authentication is necessary to track usage limits and manage subscriptions

3.2 Account Responsibilities

• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities that occur under your account
• You agree to provide accurate information and to keep it updated
• You must notify us immediately of any unauthorized use of your account

4. Free Tier, Fair Use, and Limits

4.1 Free Tier Features

• The free tier provides monthly usage limits per feature (e.g., merges, splits, conversions)
• Limits are shown in‑app and reset monthly
• Free tier includes basic PDF operations with reasonable usage restrictions
• Access to core features like merge, split, compress, and convert

4.2 Fair Use Policy

• We may adjust free tier limits over time for fairness, performance, or business reasons
• Changes to limits will be reflected in the App with reasonable notice
• Abuse, automated scraping, or attempts to bypass limits are prohibited and may result in suspension or termination
• Commercial use may require a premium subscription

5. Subscriptions, Trials, and Billing

5.1 Premium Subscription Plans

Premium subscriptions are offered via Google Play Billing and are subject to Google Play Terms and payment policies.

• Monthly: $4.99 USD per month
• Annual: $39.99 USD per year (save approximately 33%)
• Lifetime: $79.99 USD one-time payment

Note: Pricing is subject to change. Free trial may be available for new users.

5.2 Premium Features

• Unlimited PDF operations (no monthly limits)
• Advanced compression settings with quality control
• Batch processing of multiple documents
• Custom watermark templates and positioning
• Enhanced OCR capabilities
• Priority customer support
• Ad-free experience
• Early access to new features

5.3 Auto-Renewal and Billing

• Subscriptions auto‑renew unless canceled at least 24 hours before the end of the current period
• Your payment method will be charged through Google Play Store
• Your access to premium features continues until the end of the paid period after cancellation
• Lifetime purchases do not auto-renew

5.4 Managing Subscriptions

• Manage or cancel subscriptions in your Google Play account settings
• Visit Google Play Subscriptions
• We do not process refunds directly; refund requests follow Google Play policies

5.5 Refund Policy

• Refund requests must be submitted to Google Play Store according to their policies
• We may consider refunds at our sole discretion for technical issues that prevent app usage
• Refunds are generally not available for partial subscription periods

6. User Content and On‑Device Processing

6.1 Your Documents

• Your documents remain yours. PDF operations are performed locally on your device whenever possible.
• We do not upload or store your document content on our servers
• You retain all ownership and intellectual property rights to your documents

6.2 Your Responsibilities

You are solely responsible for:

• The content you process in the App
• The legality of possessing or modifying that content
• Obtaining any necessary rights or permissions for documents you process
• Ensuring compliance with applicable copyright, trademark, and intellectual property laws
• Backing up important documents before processing

7. Acceptable Use

You agree not to:

• Use the App in violation of any law or rights of others
• Infringe intellectual property, privacy, or publicity rights
• Process documents containing illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
• Reverse engineer, decompile, or otherwise attempt to extract source code where not permitted
• Interfere with or disrupt the App, bypass rate limits, or probe vulnerabilities
• Use the App to create, process, or distribute malware, unlawful, or harmful content
• Use another person's account without permission
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App for commercial purposes beyond reasonable personal/business use without appropriate subscription
• Automate access to the App or use it in a manner that could damage, disable, or impair the service

8. Intellectual Property; License

8.1 Our Intellectual Property

• We (and our licensors) own all rights in the App, including software, UI, logos, and trademarks, except for content you provide
• PDF Lab name, logo, and associated marks are trademarks of Blue Sparrow Labs

8.2 Limited License

Subject to these Terms, we grant you a personal, revocable, non‑exclusive, non‑transferable, limited license to install and use the App on a device you control solely for personal or internal business purposes.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer or attempt to extract the source code except as permitted by law
• Remove or alter any proprietary notices
• Use the App to develop competing products or services

9. Third‑Party Services

9.1 Integrated Services

The App integrates third‑party services, including:

• Google Play Billing: For subscription and payment processing
• Firebase Authentication: For user authentication and account management
• Firestore: For storing usage data and preferences
• Google ML Kit (on‑device): For OCR and document scanning capabilities

Your use of those services may be subject to their terms and privacy policies. We are not responsible for third‑party websites or services.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what we collect and why, how we use and share information, and your rights. Please review the Privacy Policy carefully. By using PDF Lab, you consent to the practices described in the Privacy Policy.

11. Disclaimers

11.1 "AS IS" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON‑INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS
• UNINTERRUPTED OR ERROR-FREE OPERATION

11.2 No Guarantees

• WE DO NOT WARRANT THAT THE APP WILL BE ERROR‑FREE OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED
• We do not guarantee the quality, accuracy, or completeness of PDF operations
• Results may vary based on device capabilities, document complexity, and file formats
• YOU ARE RESPONSIBLE FOR BACKING UP YOUR FILES AND VERIFYING OUTPUTS BEFORE RELYING ON THEM

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• THIS INCLUDES ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL
• ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP
• EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP OR THE SUBSCRIPTION DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations may not apply to you to the extent prohibited by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless Blue Sparrow Labs and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with:

• Your misuse of the App
• Your violation of these Terms
• Your violation of any laws or third‑party rights
• Content you process through the App
• Your negligence or willful misconduct

14. Termination; Suspension

14.1 Termination by Us

We may suspend or terminate your access to the App (including free tier and subscriptions) at any time if:

• You violate these Terms
• We need to protect the App or other users
• Required for legal or security reasons
• You engage in fraudulent activity or abuse

14.2 Termination by You

• You may stop using the App at any time
• To delete your account, see our Account Deletion page
• To cancel your subscription, manage it through Google Play Store

14.3 Effect of Termination

Sections that by their nature should survive termination shall survive (e.g., disclaimers, limitations of liability, indemnification, and governing law).

15. Changes to the App and Terms

• We may update the App's features, free tier limits, and these Terms
• When we make material changes, we will notify you by updating the Effective Date and/or providing notice in the App
• Continued use of the App after changes become effective constitutes acceptance of the updated Terms
• If you do not agree to the updated Terms, you must stop using the App

16. Governing Law; Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to conflict of law principles. If you reside in the EU/EEA/UK or another region with mandatory consumer protections, you retain the protections afforded to you by such laws.

16.2 Informal Resolution

Before pursuing formal legal action, please contact us at info@bluesparrow.dev to attempt to resolve the dispute informally.

16.3 Jurisdiction

Any dispute arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction and venue of the courts located in your jurisdiction of residence, unless applicable law requires otherwise.

17. Severability and Waiver

• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect
• Waiver: Our failure to enforce any provision shall not constitute a waiver of that provision or any other provision

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blue Sparrow Labs regarding PDF Lab and supersede all prior agreements and understandings.
